Course Description

This level 3 qualification has been made for anyone that would like a career as an Enforcement Agent (old term is a Bailiff). To become a Court Certificated Enforcement Agent the candidate will need to successfully pass the qualification and will need to apply to the court court to obtain an enforcement agent court certification.  We do also offer a package assist with the administration on the enforcement agent court certification process.

EndeavourUK developed the first Enforcement Agent / Bailiff Level 3 awarding body endorsed course in history.  In early 2019 EndeavourUK worked with the awarding body to make the course into a qualification which is on the Regulated Qualifications Framework (RQF). Bailiffs are one of the world’s oldest professions but until now, no training of this level has been available. This course has been developed to help lift the quality and improve the standards and consistency within the industry.

Who is the course for?

This course has been made for anyone that would like a career as an Enforcement Agent (EA). This course covers all aspects relating to the roles and responsibilities of an Enforcement Agent. It includes Taking Control of Goods, EA Conduct, understanding the process of a number of different debt types, identifying and dealing with vulnerable people, understanding how to be an effective EA and also being able to effectively manage conflict. This Level 3 qualification covers the requirements for the new regulations for Enforcement Agents.

This course will give the candidate the information they need to apply to the county court for their enforcement agent court certification. Candidates must apply to the courts themselves for the certification. (If you would like us to do the administration to make the certification process as easy and stress-free as possible, we have a package course.)

  • Know the process that local authorities employ when issuing a penalty charge notice (PCN)
  • Know the requirements relating to enforcement agent activity when enforcing Magistrates Court warrants and Road Traffic fines
  • Know the Appeals Process for Road Traffic fines
  • Know the recovery process of a Road Traffic warrant
  • Know the debt recovery process for Council Tax (CT) & National Non-Domestic Rates (NNDR)
  • Know the enforcement process for Commercial Rent Arrears Recovery (CRAR) and Forfeiture of Lease
  • Know threats to personal safety during enforcement action
  • Know effective enforcement during enforcement action
  • Know how to deal with vulnerable people during enforcement action
  • Know how to recognize and deal with work-related stress

The assessment of this qualification:

You must successfully complete the assessment workbook and pass a classroom based exam to achieve the qualification. The exam contains of 70 multiple-choice questions that must be completed within 2 hours 30 minutes. Successful learners will have to demonstrate knowledge and understanding across the qualification and achieve a pass mark of 80%. Learners that achieve 90% or more will be awarded a Distinction grade.


Optional extra:

For learners that would like a certificate for practical, as well as this theory qualification, that confirms you can apply what was learnt in the classroom to real life – Once this Level 3 Award in Taking Control of Goods (RQF) qualification is successfully completed we can go on to the street on a one to one basis to complete a field assessment; this is an optional extra that can be booked in at a later date. Course Process:
  1. You will be given:
    • The Course booklet, this is full of information to help you through the course
    • The Course Assessment Workbook, this is for you to complete prior to the classroom training and will be handed to your tutor in the class.
    • The EndeavourUK information for EA certification form to be completed and email to be sent to the EndeavourUK office for processing and posting to court.
  2. Learners will attend five (5) days classroom training from an experienced enforcement agent tutor. The tutor will assess the Workbooks and give guidance when needed.
  3. On the last day in the classroom the learners will sit an exam.
  4. You must successfully complete the assessment workbook and pass a classroom based exam to achieve the qualification. Successful learners will then get the Level 3 Award in Taking Control of Goods (RQF) certificate. This is issued within 10 days from the exam.
  5. Candidates can then add this Level 3 Award in Taking Control of Goods (RQF) certificate to their county court application paperwork.

  • Courses start at 9:30am. Please arrive at lease 15mins early.
  • This course will finish at 4:30pm each day so please ensure you have made arrangements to stay to this time before you are booked on the course.
  • At the start of this course you will be required to show ID to the tutor.
  • At the start of this course remember to bring the completed Course Assessment Workbook that we sent to you.

What is a Bailiff / Enforcement Agent (in brief)

Is there a difference between a Bailiff and an Enforcement Agent?

  • An Enforcement Agent was originally know as a Bailiff but due to many different types of bailiff in existence the title has changed to Enforcement Agent.

The main role of an Enforcement Agent is to legally remove goods/items to clear a debt, unless payment of the debt is paid. There are many types of agents for the collection of debts, they fall into 4 main categories:

  • Private Bailiffs / Debt Collector
  • County Court Bailiffs
  • Certificated Enforcement Agents (EA) this certification is granted by the County Court
  • High Court Enforcement Officers (HCEO) also known as Sheriffs Officers

  • Certificated Enforcement Agents can operate anywhere in England and Wales.

What Laws do Enforcement Agents work under? Enforcement Agents work under three types of categories of law.

  • Legislation – Legislation include laws enacted by Parliaments, as well as laws made by persons or bodies granted law-making powers by Parliament. Legislation is also often referred to as Acts or Statutes. Certificated Enforcement Agents work under:
    • Schedule 12 of Tribunals, Courts and Enforcement Act 2007
    • Taking Control of Goods Regulations 2013.
    • Taking Control of Goods (Fees) Regulation 2014
  • Case Law – Law based on judicial decision and precedent rather than on statutes
  • Common Law – Common Law originated and was developed in England and is based on court decisions, customs and usages rather than on codified written laws

  • CIVEA Good Practice Guide,
  • Guidelines stipulated by the Client on which they are enforcing on behalf of.
  • Completing the enforcement agent course provides an excellent opportunity for all service leavers and on successful certification allows you to start work immediately after leaving the forces. There is a lot to take in to pass the exam but the experienced staff at EndeavourUK make sure that you have the knowledge to pass the exam confidently. There’s a lot of paperwork to be completed for your court certificate however this is made very easy by the excellent administration team which complete most of it for you.
    When attending court to receive your court certificate EndeavourUK will send one of their staff along to help you through the process. Standing in front of a judge can sound a bit nerve racking but you are only there for a couple of minutes and all the paperwork will have been prepared for you.
